Job Title: Global Head of Trademarks- Location: Intas (HO-Ahmedabad)Department: Global IPRReporting To: Executive Vice President- Global IPR and Portfolio (India and EM)
Key Responsibilities:1. Conduct trademark availability and clearance searches for brand names proposed by the Marketing Team. Thereafter providing search reports with risk assessment and registrability opinions. At times help Marketing Team coining the brand name applying permutations & combinations. 2. Review trademark opposition matters, including drafting and vetting of Notices of Opposition, Counter-Statements, Settlement Agreements, Undertakings, Evidence Affidavits under Rules 45, 46 and 47 of the Trade Marks Rules, 2017. Follow up and coordination with Marketing, Regulatory and Procurement Team for gathering evidence including product permissions.3. Maintain and update database of trademark, prosecution records, track statutory deadlines, and ensure timely compliance with registry requirements.4. Liason and coordination with trademark attorney and business teams on renewals, opposition proceedings, hearings and portfolio management matters.5. Support trademark enforcement and brand protection activities through legal analysis, drafting, and strategic recommendations on trademark-related matters.6. Handle trademark enforcement and litigation support matters, including coordination on infringement actions, passing-off disputes, cease-and-desist notices, oppositions, rectifications, evidence collation, and coordinate with external lawyers for ongoing trademark disputes. 7. Drafting and vetting of Plaint, Written Statement, Reply and Evidence. Appear as witness in the Court and give testimony in the trademark litigation. 8. Discuss and develop strategies with external lawyer in court matters including engaging counsel, contesting the matter or exploring settlement, formulate and negotiate 9. Design, implement, and continuously refine a proactive, enterprise-wide global trademark and trade dress strategy aligned with the corporation’s long-term commercial pipelines, global expansion, and M&A roadmap.10. Oversee the end-to-end lifecycle of a vast, high-value international trademark portfolio across regulated and emerging markets, utilizing the Madrid System, regional systems (EUIPO, ARIPO), and direct national filings.11. Establish global trademark policies, governance standards, and budget allocations across all international business units. 12. Partner closely with Global Regulatory Affairs and Medical Affairs to navigate intricate health authority naming hurdles (such as WHO-INN policies, US FDA, EMA, and national drug controllers) to eliminate risks of medication errors, LASA conflicts, and regulatory rejection.13. Direct global litigation and enforcement strategies to protect the brand against infringement, trademark squatting, unauthorized parallel imports, and sophisticated counterfeiting rings across physical supply chains and digital/e-commerce marketplaces.14. Manage high-stakes international contentious matters, including multi-jurisdictional trademark oppositions, cancellations, invalidations, and domain name (UDRP) disputes. Collaborate seamlessly with Corporate Communications, Digital Marketing, and Regulatory compliance to ensure all global promotional campaigns, packaging designs, and digital assets adhere to global healthcare compliance laws.15. To propose Global and regional brand name which are free from TM conflicts.
Candidate Profile & QualificationsEducation:Bachelor of Laws (LL.B.) or Master of Laws (LL.M.) from an accredited premier law school.Recognized qualification as a Trademark Attorney / Patent & Trademark Agent.Experience:15 to 20+ years of progressive legal experience managing a large-scale global trademark portfolio, with at least 8–10 years operating in a senior leadership or head-of-function role within a major multinational pharmaceutical/life sciences corporation or an elite global law firm practice.Industry Acumen:Deep, hands-on familiarity with pharmaceutical industry nomenclature, international classification systems, health authority naming regulations, and global supply chain vulnerabilities.Proven track record of managing multi-jurisdictional disputes and cross-border portfolio rationalization.
